Uniform Interstate Depositions and Discovery Act

The purpose of the Uniform Interstate Depositions and Discovery Act is to simplify and streamline discovery by subpoena across state lines. 47 states in the U.S. have adopted the Act. Before the Act was created, performing routine discovery by subpoena across state lines was a horrifying process, varying widely from state to state, and it was often so expensive and complicated that important case-related information was not obtained.

Adoption of the Act by the vast majority of states has reduced costs for countless clients and attorneys. In many cases, an attorney seeking discovery by subpoena in another state may follow the simple steps outlined in that state’s version of the Uniform Interstate Depositions and Discovery Act. However, sometimes, attorneys from other states may seek the assistance of counsel in the foreign state to localize the subpoena and ensure proper service.

Arkansas adopted the Uniform Interstate Depositions and Discovery Act in 2018, and Oklahoma followed in 2022.
